On May 16, 2019, the Federal Energy Regulatory Commission (FERC) denied multiple requests for rehearing, but partially granted requests for clarification, of its February 15, 2018, Order 841: “Electric Storage Participation in Markets Operated by Regional Transmission Organizations and Independent System Operators”. Order 841 sought to reduce barriers to the participation of electric storage resources in regional wholesale markets. The denial, among other things, upheld FERC’s decision not to allow state-by-state opt-outs. FERC denied rehearing by a nearly unanimous vote (one Commissioner concurred in part and dissented in part).
